301.1 The latest information on record including surprise inspection report was placed and considered.

301.2 It was noted that inspection team has recommended for legal opinion as matter covered under legal and technical implications.

b) Accordingly Facts Finding Committee were deputed for Surprise Inspection, findings is as under:-

? The Committee visited the Institution on 4.12.2023 and observed that Institute is running Adarsh Institute of Pharmacy at 543, Azamshah Layout, Nagpur.

1. The institute got approval from PCI Id – 7988 to run the B.Pharm and D.Pharm course with reference to points raised in the observation are as following –

a. The Satchikitsa Prasarak Mandal has applied for new Pharmacy institute in the premises where “Homeopathic College” was running. The affiliation of the Homeopathic institute was withdrawn by the affiliating University i.e., Maharasthra University of Health Science vide letter No. 540/2013 dated 1.4.2013. Further, the permanent closure of the institution has been notified by Govt. Of Maharashtra dated 20.4.2023.

b. The college has submitted an undertaking that approval of charity commissioner is not required, however, the legal opinion in this matter may be sought.

c. The college got approval for D.Pharm program with PCI ID – 7370 from PCI dated 4.5.02023. The college has submitted the request for merger of both the institute i.e., PCI – 7988 and PCI – 7370 through letter No. AIP/08/2022-23 dated 14.2.2023. Further, The Institute submitted the copy of information available on MSBTE portal, where no admission data is available. The copy of same has been submitted to DTE vide letter No. SPM/51/2023-24 dated 4.11.2023.

d. The NOC from the state Government, Board of technical Education & approval of D.Pharm course.

e. The college has provided the list of 26 students admitted during 2022-2023, who were transferred to other college as per the orders of Hon’ble Supreme Court of India & Department of Technical Education.

f. The resolution of society for start of B.Pharm and D.Pharm course.

g. The college has purchased the books, equipments, Chemical & Glassware.

h. The college has submitted the documents supporting that the dues of Dr. Gopal has been settled by paying the amount of Rs.10,18,614/-.

i. The list of admitted students during the session 2023-2024.

j. The inspection reports submitted by the College.

k. The copies of various court orders.

l. The college has given and undertaking that no court case is pending against Homeopathy College, regarding no receipt of grant for Homeopathy College & no other school/Institution is being run of this path of land.

m. The infrastructural facilities at the institution was verified by the Committee during the visit and also interested with students. The photographs and video pendrive is also enclosed with the report for reference.

Since the matter includes technical and legal implication, the legal opinion is this regard may be sought by the Council.

c) Legal opinion was sought from Council’s advocate Shri Ajay Kumar. The advocate opined as under –

It’s to inform you that the PCI is not required to do anything in reference to the Adarsh Institute of Pharmacy right now. If the college has done anything wrong for getting NOC from the State or Examination Body then
The State or Examination Body should have to take steps first. And on the recommendation of the State
Government or Examination Body, PCI May proceed further with any decision.

d) The State Govt. and Examining Authority (Baba Saheb Ambedkar University) as already granted affiliation / approval for 2023-2024 academic session.
